I’m an attorney, but I may not be licensed in your state, nor do I practice estate planning, so take this as you will.
If someone dies without a will, there may be (and usually are) laws that dictate how property is passed along once they die. So, it doesn’t automatically escheat to the state unless no one exists that may be able to lawfully take possession. Think of the government as a beneficiary of last resort because if no one exists that may be able to take it, someone has to do something with it.
