I own a 6.5 acre parcel with my house on it and an adjoining 1.5 acre parcel with a rental house and pole barn. Located in Michigan.
The property lines were drawn before I owned them. I would like to eventually sell the rental house, but its property line essentially extends into my front yard. I also want to keep the pole barn which has a separate driveway.
See here:
Ideally we would redraw the property lines and add around 1 acre and the barn to the bigger parcel (area in yellow) leaving the smaller home with a nice yard and 0.5 acres. However, the property lines can’t be redrawn according to the township because reasons.
Is a permanent easement a possibility? Could we legally define the area in yellow and add that to the deed permanently tying it to the bigger property?
Obviously would work with a real estate attorney on this but looking to see if its generally possible and what pitfalls there may be. Of course it would impact the sale of the smaller house somewhat. I imagine they would technically be paying taxes on the easement but it would be something a buyer would know about upfront.
