Constitution Debate: In the Rajya Sabha, Union Minister JP Nadda remarked that Article 370 introduced 35A in 1954 through a Presidential Order, bypassing parliamentary debate. He noted that 35A defined citizenship in Jammu and Kashmir, limiting it to residents before 1944. Nadda criticized the lack of discussion on Article 370’s effects, highlighting that 106 laws passed by Parliament, including the Prevention of Atrocities Act and the Human Rights Act, were not applicable in Jammu and Kashmir. He pointed out that the POCSO Act was also not enforced there. While Jawaharlal Nehru advocated for women’s property rights, these rights were not implemented in Jammu and Kashmir. Furthermore, if a Kashmiri woman married a non-Kashmiri man, she lost her property rights.
