First, our complaint. On the disclosure the previous owners said there was no flooding or problems with the well water. We found definite and obvious flooding after a certain amount of rain and rain also discolors our well water. The flooding was corrected with an interior drain, but we’ve captured plenty of pictures of that.
I understand it’s difficult to prove these, because you need something concrete that shows they had explicit knowledge of the issue. But has anybody been able to prove their case simply by how obvious the issue is? For them to truly have no knowledge, there would have had to be no rain for the entire period of their ownership, which isn’t the case. I doubt we would have purchased the house if we’d known about these problems.
Does anybody have any insight? Am I out of luck? I have an attorney who is willing to help, but he wants $300 for see if mediation is possile and, if it is, $1500 up front to handle that. He won’t give me an idea of how it will go from there, and I would hate to make this decision blind.
