Sean “Diddy” Combs made his third attempt to secure bail on Friday, Nov. 21, as part of the ongoing legal battle following his September indictment on charges related to sex trafficking, racketeering, and transportation.

The 55-year-old mogul appeared in a Manhattan federal courtroom dressed in a khaki jail-issued outfit, flashing a smile and waving toward his family, including his 17-year-old twin daughters, seated in the second row.

Despite a heated two-hour hearing, Judge Arun Subramanian did not make an immediate decision on Combs’ bail request.

However, he indicated that a decision was expected by next week. In the meantime, the judge has ordered both the US Attorney’s office and the defense to provide additional clarification regarding Combs’ communication methods while incarcerated, as mentioned in a report by People.

The judge specifically requested details on how the music mogul has been communicating from behind bars during his two months in custody at the Metropolitan Detention Center in Brooklyn. Both parties have been given until Nov. 25 to submit the requested information.

Concerns Over Witness Tampering

The latest bail hearing follows previous rejections of Combs’ bail requests, with two separate judges denying him release due to concerns over potential witness tampering. Prosecutors claim that Combs continued to attempt to influence witnesses even while in detention. They allege that he used other inmates’ phone access cards to contact people, including his sons, and made “relentless efforts” to reach out to potential witnesses. These individuals, prosecutors argue, include victims who could testify against him.

In response, Combs’ defense team has argued that the government’s case is “thin” and proposed a strict set of release conditions, including a $50 million bail. They have maintained that the charges against Combs are unsubstantiated and that the continued denial of bail is unjust.

Bureau of Prisons Controversy

The Friday hearing marked the second appearance in court this week for Combs, who faced scrutiny over a controversial jail sweep conducted by the Bureau of Prisons.

On Nov. 19, Judge Subramanian ruled that evidence obtained during the sweep would not be considered in the bail proceedings. Combs’ attorneys had condemned the sweep as “outrageous government conduct” and a violation of due process, claiming that 19 pages of notes seized during the sweep were legal materials and therefore privileged.

In a rare move, the prosecution was instructed to destroy its copies of the materials.

The prosecution, however, countered that the sweep had been planned before Combs’ arrest and was not specifically aimed at him or any other inmate.

Despite the sweep’s findings, Combs’ legal team argued that most of the seized materials were protected by attorney-client privilege.

Bail Conditions and Future Developments

The charges against Combs focus on the alleged operation of “freak offs,” wherein women were reportedly coerced into participating in sexual activities with male sex workers.

The defense team’s argument for bail includes a proposal for strict conditions upon release, but the prosecution’s accusations of witness tampering and the ongoing investigation present significant challenges.

If granted bail, Combs is expected to reside on Manhattan’s Upper East Side, a detail that could be significant in light of the ongoing legal developments, as mentioned in a report by People.
